Terms and Conditions

These are the Terms and Conditions upon which Market Flowers  (“we/us”) makes this website (the “Market Flowers Site”) and any of our services which are accessible on or via the Market Flowers Site (the “Market Flowers Service”) available to you.

1. Market Flowers Products

1.1 All of the arrangements depicted on this website (as may be varied from time to time) are available for delivery anywhere in Jersey.

1.2 We may deliver our flowers in bud to ensure longer life.

1.3 Some of our flowers/plants may be harmful or poisonous, please contact us if you require further information before submitting an order (see 6.1).

1.4 All of our arrangements are subject to availability. In the event of any supply difficulties, we reserve the right to substitute with an alternative flower/arrangement of equivalent value and quality without notice.

1.5 In the event that we are unable to supply the requested arrangement or any substitute product, we shall notify you as soon as is reasonably practical for further instructions. If you do not wish to provide an amended order, we shall reimburse your payment in full as soon as possible.

2. Prices

2.1 Prices listed within the Market Flowers Site are valid for a maximum of 14 days from the date your order is submitted. There can often be considerable price fluctuations during peak periods (especially Valentine’s Day, Mother’s Day and Easter) although we will endeavour to update our price list as soon as practical to avoid inconvenience.

2.2 All Product prices quoted will exclude our delivery charge. Several items ordered for delivery to the same address at the same time will be subject to one delivery charge.

3. Orders / Payment

3.1 You will be given clear instructions on how to navigate the order form and you will be required to provide us with your complete personal details, including a full postcode, together with those of the intended recipient as well as all necessary payment details. We accept payment by most major credit and/or debit cards. By clicking on the ‘Proceed’ button on the order form, you are consenting to be bound by these Terms and Conditions.

3.2 Submitting your order form is subject to our acceptance of this order which we issue by e-mail to the e-mail address provided on your order form. We will not consider ourselves bound by a contract with you until we have issued this confirmation.

3.3 We cannot accept order forms from customers under the age of eighteen (18) years.

4. Delivery

4.1 We cannot guarantee that your order will be delivered during a certain period or by a certain time, although we will do our utmost to meet your requirements wherever possible. The exception to this is for wedding and funeral orders where we would ask that a minimum of 24 hours’ notice is given together with precise details of the required delivery time in order to avoid disappointment.

4.2 Incorrect personal details may lead to problems or delays in delivery, so before placing your order, please ensure that you have included the full address details, including an accurate postcode of the intended recipient as well as your daytime contact telephone number so that we can notify you in the event that any delivery problems are encountered.

4.3 In case of delivery to certain locations, such as hospitals and hotels, the signature of any person authorised to accept delivery on behalf of the organisation shall be accepted as proof of delivery to your chosen recipient. Full information to hospital wards or hotel room numbers must be provided at the time of order to avoid disappointment.

4.4 Should we encounter difficulties delivering your order we reserve the right to contact the recipient using the contact details provided on your order form. If we are not able to contact the recipient, orders will normally be left on the premises (provided a safe environment is available) or with a close neighbour. If none of the above options are possible, we will revert to you for further instructions.

4.5 It is the sender’s responsibility to ensure that the recipient is available in Jersey to receive the order on the requested delivery date. If it transpires that the recipient is not in fact available to take receipt of your order, we reserve the right to deduct a charge, covering the preparation and delivery costs incurred by Market Flowers in processing your order, prior to affecting a refund in accordance with clause 1.5.

5. Cancellation

5.1 To amend or cancel your order, please contact Market Flowers between the hours of 8:00am and 17:00 Monday to Saturday except for Thursdays between 8:00am and 14:00 (excluding Public Holidays) using the contact details set out in Section 6.1 below. Orders may be amended or cancelled up to 24 hours before the intended delivery date. A full refund will then be made in accordance with clause 1.5.

6.2 We will do our utmost to rectify all reasonable complaints concerning our products and/or service. However, given the perishable nature of our products, and in order to assist us in resolving any complaints quickly and to our mutual satisfaction, we advise you to make any complaint within one working day of the date of delivery or intended delivery of your purchase.

7. Disclaimer

7.1 Whilst we agree to use all reasonable endeavours to ensure that our Website is fully operational and error-free we cannot guarantee this. We therefore accept no responsibility for any defects and/or interruption to our service and shall be released from our obligations under these Terms and Conditions in the event of any cause beyond our reasonable control, which renders the provision of the Website impossible or impractical.

8. General

8.1 We reserve the right to supplement and amend the Terms and Conditions on which you are permitted access to the Website from time to time. We will post any changes on our Website and it is your responsibility as a customer to review the Terms and Conditions on each occasion you access the Site. Changes will be effective five (5) hours after the posting of any such change and all subsequent dealings between you and us shall be on the new terms and conditions.

8.2 Additionally, we reserve the right to suspend, restrict or terminate access to the Website for any reason at any time.

8.3 These Terms and Conditions shall be deemed to include all other notices, policies, disclaimers and other terms contained in our Website, provided that in the event of a conflict between any such other notices, policies, disclaimers and other terms, these Terms and Conditions shall prevail. If any of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

8.4 We shall ensure that we comply with the requirement of all current data protection legislation including, without limitation, the Data Protection (Jersey) Law 2005 (as replaced, modified or re-enacted from time to time). We shall only use personal data received from you for the purpose of fulfilling our obligations under these Terms and Conditions.
